Welcome to Devicely. By installing and using the Devicely Shopify App ("App"), you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our App.
By accessing or using the App, you ("Merchant," "you," or "your") accept and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App, including without limitation merchants, store owners, and administrators.
Devicely is a Shopify application that allows merchants to create dynamic discount rules based on the device tier (e.g., TOP, MIDDLE, LOW_COST, OBSOLETE) of the store visitor. We provide analytics, device detection capabilities, and targeted discount mechanisms.
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice.
As a user of the App, you agree to the following:
Devicely offers various subscription tiers, including Free and Premium plans. By selecting a paid plan, you agree to pay the fees associated with that plan as billed through the Shopify billing system.
All content, features, and functionality within the App (including but not limited to software, code, algorithms, UI/UX, text, and logos) are owned by Devicely and are protected by international copyright, trademark, patent, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our App or included software without our explicit written consent.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Devicely makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials included.
We do not warrant that the App will be uninterrupted, error-free, completely secure, or that any defects will be corrected. Furthermore, we do not guarantee any specific increase in sales or conversions through the use of dynamic discounts.
To the maximum extent permitted by law, in no event shall Devicely, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
In no event will Devicely's total liability to you exceed the amount you paid for the App in the 3 months preceding the claim.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Devicely operates, without regard to its conflict of law provisions.
